TX HB 1492 Suppressor Bill — What Does It Mean For Texas Gun Owners?

There’s been a lot of discussion about Texas HB 1492, the suppressor bill that passed the House last week. Let me break down what it actually says and what it means for Texas gun owners.

What the bill does:
The bill would create a state-level registry for suppressors manufactured entirely within Texas and assert that such suppressors are exempt from NFA regulation. This is a 2nd Amendment sanctuary-type bill.

The legal reality:
Federal courts have consistently ruled that the Commerce Clause gives Congress authority to regulate items that “substantially affect” interstate commerce, which courts have found includes firearms and accessories even if made in-state. Similar bills in other states have not survived legal challenges.

What this means practically:
Don’t throw away your Form 4 yet. Even if this bill passes and is signed, any Texas suppressor manufacturer would need to test this in federal court, which would take years. The NFA still applies until there’s a definitive federal court ruling otherwise.

What’s more useful:
The Hearing Protection Act has been introduced again in Congress. That bill would actually remove suppressors from NFA regulation at the federal level. That’s the legislation worth tracking.
